Unauthorized migration to the United States: Review and
Assessment of Current Theories
Abstract
Almost 12 million unauthorized immigrants live in the United States. This situation
raises critical questions that have received four types of answers within the academy:
i) one that objects to the poor design of immigration policies, ii) one that sustains that
there is a clash between the transnational process of globalization and the out-dated
nationalistic immigration policies, iii) one that historicizes the process of illegalization
of immigrants, and iv) one that highlights diverse forms of citizenship and national
membership such that illegalization does not have the power of absolute exclusion
because citizenship and integration into a society are not an «all-or-nothing-affair». The
present work seeks to unpack these approaches as theories of the undocumented and
to address them critically. The final reflections seek to contribute to the fourth kind of
response in order to put forward a perspective that makes visible the political nature of
particular actions (illegal border crossing, unauthorized stay in the USA) that are not
usually considered as such.
Key words: illegitimate citizenship, informal citizenship, postnational states, illegalization,
liminal legality.
